1. Agreement to Terms

By accessing or using TrendStruct ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

TrendStruct is a construction market intelligence platform that provides:

• Aggregated permit data and market intelligence from 18+ major US metros
• Pipeline forecasting and trend analysis
• Automated alerts and reports
• API access for programmatic data retrieval (Professional tier and above)
• Natural language chat for data queries (Business tier and above)

Service features and availability vary by subscription tier. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts

Registration

You must create an account to use TrendStruct. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service. You may cancel your account at any time through your account settings.

4. Subscription & Billing

Pricing & Payment

Subscription fees are billed monthly or annually based on your selected plan. All payments are processed securely through Stripe. You agree to:

• Provide valid payment information
• Authorize automatic recurring charges
• Pay all applicable taxes
• Update payment information promptly if it changes

Free Trial

New users receive a 14-day free trial. No credit card is required to start the trial. After the trial period, your subscription will begin unless you cancel before the trial ends.

Refunds

Subscription fees are non-refundable except as required by law. If you cancel, you retain access until the end of your current billing period.

Price Changes

We may modify subscription prices with 30 days' notice. Changes apply to subsequent billing periods. Continued use after price changes constitutes acceptance.

5. Usage Limits & Rate Limits

Each subscription tier includes specific usage limits:

• Alerts: 10-500 per month depending on tier
• API Calls: 100-5,000 per month (Professional tier and above)
• Chat Queries: 20-500 per month (Professional tier and above)
• SMS Alerts: Maximum 3 per day per user

Exceeding limits may result in service interruption. Systematic attempts to circumvent limits may result in account termination.

6. Acceptable Use Policy

You agree NOT to:

• Resell, redistribute, or sublicense TrendStruct data without authorization
• Use automated systems to scrape or harvest data beyond API limits
• Attempt to reverse engineer or circumvent security measures
• Share account credentials with unauthorized users
• Use the Service for illegal purposes or to violate regulations
• Transmit malware, viruses, or malicious code
• Impersonate others or misrepresent affiliation with TrendStruct
• Use data to identify or track specific individuals or contractors

7. Intellectual Property

Our Rights

TrendStruct, its platform, data aggregation methods, algorithms, and all related intellectual property are owned by TrendStruct and protected by copyright, trademark, and other laws. Your subscription grants a limited, non-exclusive, non-transferable license to access and use the Service for internal business purposes only.

Data Usage Rights

You may use TrendStruct data and reports for internal business analysis and decision-making. You may not publicly redistribute raw data or create competing services using our data. White-label reports (Business/Enterprise tiers) may be shared with clients under your branding.

8. Data Accuracy & Disclaimers

NO WARRANTY: TrendStruct is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not guarantee:

• 100% accuracy of permit data or forecasts
• Uninterrupted or error-free service
• That data is current or complete for all cities
• Specific business outcomes from using the Service

TrendStruct provides market intelligence tools, not investment, financial, or legal advice. You are solely responsible for business decisions made using our platform.

9. Limitation of Liability

To the maximum extent permitted by law, TrendStruct and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TrendStruct from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your violation of these Terms, (b) your use of the Service, (c) your violation of any third-party rights, or (d) unauthorized access to your account due to your failure to secure credentials.

11. Third-Party Services

TrendStruct integrates with third-party services (Stripe for payments, Resend for emails, etc.). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service failures or data breaches.

12. Privacy

Your use of TrendStruct is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the platform at least 30 days before taking effect. Continued use after changes constitutes acceptance of the updated Terms.

14. Termination

You may cancel your subscription at any time through account settings. Upon termination:

• Access to the Service ends at the end of your current billing period
• No refunds for partial months
• Your data is retained for 30 days for potential recovery
• After 30 days, all personal data is permanently deleted

We may terminate accounts immediately for violations of these Terms or illegal activity.

15. Dispute Resolution

Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.

Arbitration
